Best Price Guarantee – Terms and Conditions

These terms and conditions apply to the “Best Price Guarantee” program offered by Packly Pringraf S.r.l., a sole proprietorship, located at Via Amerigo Vespucci, 14 – Campochiaro (CB), Italy (hereinafter “Packly”).

1.1 The terms and expressions listed below have the following meanings, it being understood that terms defined in the singular are also defined in the plural and vice versa:

• “Packly”: refers to Packly Pringraf S.r.l., a sole proprietorship, located at Via Amerigo Vespucci, 14 – Campochiaro (CB), Italy;
• “program”: refers to the “Best Price Guarantee”;
• “customer”: refers to any individual or entity purchasing products or services from Packly;
• “best price”: refers to a lower price for the same product offered by Packly;
• “competing offer”: refers to an offer for a product that meets the same criteria (model, size, material, printing, special finishes, quantity) at a lower price than that offered by Packly;

2.1 The Best Price Guarantee program was created to ensure our customers get the best price for packaging. If a customer finds a competing offer with a price lower than that offered by Packly, and such offer meets the defined criteria, Packly commits to match that price. The comparison must be made on the net amount payable, including shipping costs and other applicable charges, except for VAT.

3.1 Customers intending to take advantage of the program must submit a request through the form on the program page https://www.pack.ly/box/en/best-price-guarantee-packaging, providing all details of the competing offer, including the web address of the competing offer (link), price, and supporting information that confirms the lower price.

3.2 The web address where the offer is found must be publicly accessible and verifiable by the Packly team.

3.3 Packly reserves the right to verify the validity of the competing offer and its authenticity, before accepting the request and therefore matching the price.

3.4 The program applies exclusively to online offers, excluding private negotiations, bulk discounts, or promotions of any kind.

4.1 Request via online form

4.1.1 To benefit from the Best Price Guarantee, it is necessary to (i) meet the conditions mentioned above and (ii) fill out the request form.

4.1.3 Packly cannot be held responsible if errors or incomplete information are entered by the customer, and for this reason, Packly cannot apply the Best Price Guarantee under the conditions specified in this document.

4.2 Screenshot

4.2.1 A screenshot showing both the date and the lower price found on the competitor’s site must be attached to the request form, along with any other supporting documents for the request. Incomplete or incorrect requests, or those including unsuitable or incomplete documents, will not be processed.

4.2.2 The screenshot must clearly show the product details and what is required in these terms and conditions, so that the quote can be generated and obtained as displayed in the screenshot submitted.

5.1 The program does not apply to:

• customized products that are not directly comparable;
• currency differences;
• promotions and/or discounts of the competing offer;
• quotes generated from private negotiation and special initiatives of any kind.

6.1 After a check by Packly’s customer service, you will be able to benefit from the Best Price Guarantee if your request meets all the conditions mentioned in this document. Packly’s customer service will contact you at the email address entered in the form, with the details of the quote and instructions for making the purchase at the discounted price, via coupon.

6.2 The discount coupon and the best price guarantee program cannot be combined with other initiatives.

6.3 If the request does not meet the conditions of the Best Price Guarantee, Packly’s customer service will send an email indicating that it is not possible to benefit from the Best Price Guarantee, specifying the reasons for such refusal.

7.1 Packly will not be liable for any losses or damages resulting from the inclusion of any forecast or from the modification of the program’s specifications, except in cases of fraud or gross negligence.

7.2 For any communication related to the Best Price Guarantee Program, each customer must contact Packly’s customer service by communicating their username or email.

7.3 Packly reserves the right to modify these general terms and conditions at any time. The modified terms and conditions will come into effect on the date they are published on the website and will apply to any request submitted on the website from the moment of their publication.

7.4 Packly invites the customer to carefully read these general terms and conditions before each request, as they may have been modified. Each request involves prior consultation and acceptance of these general terms and conditions through a specifically provided checkbox, which includes a hyperlink that refers to these general terms and conditions.

7.5 Packly also reserves the right to terminate the Best Price Guarantee at any time, specifying that requests submitted before the termination will be processed by Packly according to the terms and conditions specified in this document.

8.1.1 Le presenti These Conditions are subject to Italian law. For all orders coming from subjects that can be qualified as consumers, the regulations on consumer relations in force in the country of residence or domicile of the Customer apply. For all orders placed by individuals qualifying as consumers, the applicable laws regarding consumer relations in the country of residence or domicile of the Customer shall apply.

8.1.2 Any disputes relating to the interpretation and/or execution of these Terms and Conditions will be exclusively under the jurisdiction of the court of:

• Campobasso (Italy), in the case of purchases made by Customers not qualified as consumers;
• the court of residence or domicile of the Customer, in the case of purchases made by Customers qualified as consumers.

8.1.3 The consumer residing in the European Union should be aware that the European Commission has established an online platform that provides an alternative dispute resolution tool. This tool can be used by European consumers to resolve, in a non-judicial manner, any disputes arising from or related to contracts for the sale of goods and services entered into online. Therefore, the Customer making purchases as a consumer may use this platform for the resolution of any dispute arising from the online contract concluded with Packly.
